Conditions of entry and stay in Montenegro.

Following the adoption of the new edition of the Aliens Act in January 2009, Montenegro is still available for a country visit. According to the amended law, Russian citizens allowed visa-free entry and continuous stay up to 30 days. Citizens of Russia, Ukraine, Belarus, after the expiration of 30 days must leave the country and enter again, which again will allow them to stay in Montenegro for the next 30 days. For the citizens of each country separately visa issues stay in Montenegro is regulated separately.

It should be noted that in order to enter Montenegro for up to 30 days to the citizens of the Republic of Belarus on the border except for a valid passport will need an invitation from a legal or natural person.

Rules of stay of foreigners in Montenegro for up to 90 days - with or without a visa (boravak do 90 dana):

Kinds and types of visas:

 Air-Transit (visa A)
Foreigners in the transit interchange department or in an airplane during an airport Montenegro, there is no need to have a visa.

Transit (visa)
In that case, if you follow in another country through Montenegro to enter the transit visa is issued for one, two or more passages. Transit visa may be issued for up to six months with a maximum stay in the country for five days. Short-term visa (C)

Foreigners who have U.S. or Schengen visas of those states, where Montenegro is not a diplomatic mission may be in the territory of Montenegro up to 7 days.

Refusal to issue, cancellation of visa and entry ban may be in the following cases:

    *
      If a foreigner does not have sufficient material means to live during their stay in Montenegro and to return to the state comes from, or to extend the trip to another state;
    *
      if it is in transit, but does not fulfill the conditions for entry into another State;
    *
      if subject to the conditions in force when the protective measure of deportation or expulsion of a protective measure;
    *
      if there is no evidence of vaccination, and enters the territory in which there are epidemics of infectious diseases;
    *
      If required by the conditions of security and public order;
    *
      if there is reasonable suspicion that an alien can commit a crime which is punishable by law;
    *

    *
      if the alien did not personally respond to the invitation of the diplomatic or consular representation of Montenegro abroad.

Exception: a visa is in the interests of Montenegro or required by an internationally recognized obligation or humanitarian purposes.

Against the refusal of a visa alien may file a complaint with the Ministry of Internal Affairs. Interior Ministry is obliged to consider the complaint within 8 days from the date of the complaint.

Border controls on entry, exit Montenegro. Compulsory registration:
Entry and exit from Montenegro, any foreigner is obliged to pass border controls. Children, if they fit into the parent's passport, can enter and leave the country only in the presence of a parent.

Problems at the exit of Montenegro may occur if:

For a stay of foreigners in Montenegro more than 90 days must obtain a temporary residence permit (privremeni boravak):

Temporary residence permit can be obtained in the internal affairs of Montenegro in the community.

Prerequisite for obtaining a residence permit are:

    *
      sufficient funds for living;
    *
      providing evidence of justification for temporary residence;
    *
      availability of health insurance;
    *
      when you first apply for the issuance of the first temporary stay - criminal record.

Basis for obtaining a temporary residence permit may be:

    *
      employment and work, the implementation of economic or business activities on the territory of Montenegro;
    *
      implementation of seasonal work;
    *
      study in special secondary and higher educational institutions;
    *
      participate in international exchange programs schoolchildren and students, as well as other youth programs;
    *
      for special vocational training, practical training;
    *
      conducting research;
    *
      for medical treatment;
    *
      for the purpose of family reunification;
    *
      Humanitarian and other valid reasons specified by law or international agreement;
    *
      in the case of marriage to a citizen of Montenegro;
    *
      in respect of a child born in the territory of Montenegro.

Each of these grounds for obtaining a residence permit requires the collection and delivery of the package of documents.

* The main method of obtaining a temporary residence permit - this is work and work, the implementation of economic or business activities on the territory of Montenegro.

In this case, a residence permit may be issued after first obtaining a work permit (Dozvola za zaposljavanje). To do this with the State Employment Bureau (Zavod za zaposljavanje) at the place of registration of a company file:

Cost of services for registration of the first boravka is 320 €, which includes:

    * A work permit - 50 €;

    * Obtaining employment and medical books - 20 €.

In the case of a foreigner to take up employment and working without valid work permits or residing in Montenegro for the purpose, does not correspond to that for which he issued a permit, or threatens public order, he may be refused leave and barred from entering the territory of Montenegro, what will make a mark in his travel document (passport).

The temporary stay will be terminated if:

    *
      the alien will be denied a stay up to 90 days, or in temporary accommodation;

      validity of the temporary residence permit expired.

Temporary residence permit is issued for up to one year, unless the Aliens Act or any other international treaty provides otherwise, and may be extended to two years. Obtaining permanent residence in Montenegro (stalno nastanjenje).

Permanent residence permit can be issued to foreigners if:

    *
      alien continuously residing in Montenegro before the date of application - for five years on the basis of temporary residence. The five-year period may be shortened for humanitarian reasons or for the benefit of the country. As residence for five years is staying, where the total period of absence in Montenegro does not exceed 10 months or 6 months in a row;
    *
      alien of at least 3 years is married to a citizen of Montenegro, or foreigners who have permanent residency in Montenegro;
    *
      the alien is a minor in temporary residence in Montenegro, one of the parents foreigner with permanent residence permit, with the consent of the other parent;
    *
      the foreigner is a Montenegrin by birth or close family member of a citizen of Montenegro, or a foreigner who has permanent residence permit, as well as an alien who is recognized as a refugee. Time that a foreigner had spent fulfilling the measure of imprisonment is not included in the time required for issuing a permit for permanent residence.

Be denied a permit for permanent residence if the alien:

    *
      is convicted of a crime or if the criminal case initiated legal proceedings;
    *
      has no means of living;
    *
      has no medical insurance;
    *
      has no place to stay;
    *
      threaten security and public order;
    *
      misrepresents their identity or conceal facts that are relevant to the authorization.

Right of permanent residence may be terminated if the alien:

    *
      subject to deportation or exile;
    *
      expelled from Montenegro or continuously resided outside the territory of Montenegro, more than 1 year, but this is not opovestil authority;
    *
      was denied permanent residence;
    *
      abandoned residence and submitted a written declaration of renunciation;
    *
      received a Montenegrin citizenship.

Obtaining a permanent residence permit immediately gives all the privileges of Montenegrin foreign national in respect of employment, training, recognition of diplomas, social, pension, medical, government support, tax credits and benefits.

Those citizens of the former republics of Yugoslavia, who settled in Montenegro until 3 June 2006, obtained a permanent residence permit automatically.
